According to the complaint described in the report, James is seeking to stop Kalshi from doing business in New York. The state argues that the company’s prediction market activities amount to wagering and therefore fall under rules that require proper approval before taking bets from residents.
The legal challenge puts fresh attention on how prediction markets are treated under state law. New York’s position, as outlined in the lawsuit, is that Kalshi cannot offer this type of betting-like product in the state without meeting licensing standards.
